Terms of Service

1. Acceptance of Terms

By accessing or using the Neighborhood Intelligence service provided by RuTrueBenz (“we”, “our”, or “us”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

2. Service Description

Neighborhood Intelligence is a data synthesis and report generation tool that compiles publicly available information from third-party sources, including but not limited to census data, school ratings, crime statistics, transit information, and environmental risk indices. Reports are generated dynamically using public and third-party APIs.

The service is intended solely as a research and organization tool for licensed real estate professionals and other users. It does not provide real estate advice, legal advice, appraisals, or recommendations to buy, sell, or avoid any property or neighborhood.

3. Tokens and Payments

Generation of reports requires digital tokens. One token is consumed for each single-address report generated.

• Tokens are priced at $1.00 USD per token.
• The minimum purchase is 5 tokens ($5.00 USD).
• Payments are processed securely via Stripe.
• All token purchases are final and non-refundable once used.

4. User Conduct and Responsibilities

You agree not to scrape, automate, reverse-engineer, or access the service through unauthorized means. You are responsible for maintaining the confidentiality of your account credentials and token balance.

If you are a licensed real estate professional, you acknowledge and agree that:

• You remain solely responsible for compliance with all applicable fair housing laws, including the Fair Housing Act and any state or local equivalents.
• You will not use any report or data provided by the service to engage in steering or any other discriminatory practice.
• You will independently review and verify all information before sharing it with clients.
• The service does not relieve you of any professional, legal, or ethical obligations.

5. Nature of Reports and Disclaimers

All reports are provided strictly “as is” and “as available” for informational purposes only. We compile and synthesize publicly available data from third-party sources. We do not create original data, conduct independent investigations, or guarantee the accuracy, completeness, reliability, or timeliness of any information, including but not limited to school ratings, crime statistics, demographic data, environmental risks, or amenity locations.

Important:

• Reports do not constitute real estate advice, legal advice, investment advice, or a recommendation regarding any property or neighborhood.
• Any interpretive language, trade-off observations, or buyer considerations contained in reports are generated automatically from available data signals and are not professional opinions or recommendations.
• Users must independently verify all critical information with primary sources, local authorities, and qualified professionals before making any decision.
• We expressly disclaim any liability arising from the use or interpretation of the reports.

6. Limitation of Liability

To the maximum extent permitted by law, RuTrueBenz and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities, arising out of or related to your use of the service or any report, whether based on warranty, contract, tort (including negligence), or any other legal theory.

Our total aggregate liability for any claim arising out of or relating to these Terms or the service shall not exceed the amount you paid us for the specific tokens used to generate the report giving rise to the claim in the twelve (12) months preceding the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless RuTrueBenz and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the service or any report; (b) your violation of these Terms; (c) your violation of any applicable law, including fair housing laws; or (d) any claim by a third party arising from your distribution or use of a report.

8. Intellectual Property

The service, including its design, code, branding, and the structure and presentation of reports, is owned by RuTrueBenz and protected by applicable intellectual property laws. You may use individual reports solely for your internal professional purposes. You may not resell, redistribute, or create derivative works from the reports or the underlying service without our prior written consent.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the service shall be resolved exclusively in the state or federal courts located in Contra Costa County, California.

10. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Your continued use of the service after any changes constitutes acceptance of the revised Terms.
